The Alabama Legislature wants to shut down the Hemp Industry and psychoactive cannabinoids in the State of Alabama.


SB321/2026, sponsored by Alabama State Senator Tom Butler, would classify psychoactive cannabinoids derived from hemp as controlled substances, including Delta-8, Delta-9, and Delta-10 THC.


This legislation would effectively destroy what remains of the Alabama Hemp Industry.

 SYNOPSIS OF SB321/2026 Delta-9 tetrahydrocannabinol (Delta-9 THC) is a psychoactive cannabinoid found in high concentrations in marijuana and in very low concentrations in hemp. Through various chemical processes, cannabidiol (CBD), which is found in high concentrations in hemp, can be converted into psychoactive cannabinoids such as Delta-8 THC, Delta-9 THC, and Delta-10 THC.


Existing law lists tetrahydrocannabinol (THC) as a Schedule I controlled substance but explicitly exempts THC found in hemp. SB321/2026 would change that. This bill would provide that only non-psychoactive cannabinoids derived from hemp would remain exempt, meaning psychoactive cannabinoids derived from hemp would be classified as controlled substances.


Under existing law, consumable hemp products may be sold to individuals over the age of 21, subject to restrictions on where the products may be sold and testing and labeling requirements. SB321 would repeal that law.
